TERMS AND CONDITIONS AGREEMENT OF SALE
Please read them carefully
The use of this site is governed by the TERMS AND CONDITIONS AGREEMENT OF SALE set forth below. Your use of this site or purchase from TACKLE CLUB indicates your acceptance of these terms and conditions.
TACKLE CLUB reserves the right to make changes to this web site and these terms and conditions at any time without any prior notice.
TACKLE CLUB is the service provider; it is also referred to as " TACKLE CLUB", "us" and "we".
Customer is the person or organisation who purchases or seeks services from TACKLE CLUB; it is also referred to as "you".
PLACING ORDERS
No Overseas orders are accepted except for orders from New Zealand .
All other orders placed are subject to confirmation and acceptance by TACKLE CLUB. TACKLE CLUB may vary prices for received orders in the event of price changes. We will advise you if this is the case.
Ordering methods acceptable include E-mailing our sales or submitting order phone.
Quantity in stock does not take into account the orders already placed which are yet to be processed. It is possible that an order placed earlier will receive the allocation of the part in which the quantity for it showed as in stock at the time of your order. Inventory discrepancy can also affect the accuracy of the stock status displayed on our web site.
Any attempt to cancel an order must be made as soon as possible. Cancellations attempted after the dispatching will result in the customer having to pay the shipping and handling charges on the package and the cost of shipping the package back.
Cancellations may be communicated by email or post.
PAYMENT
At this point in time, TACKLE CLUB uses Shopify, Afterpay , Zippay & PayPal to accept credit cards for payment of goods. We do accept direct deposits, bank cheques, personal cheques and money orders.
The title of the goods supplied does not pass to the customer from TACKLE CLUB until the full amount is paid and funds are cleared in our bank account.
SHIPPING
We do not ship to third party addresses unless that address is known and can be verified by TACKLE CLUB. Customers are responsible for paying any freight charges incurred by refused shipment and unclaimed goods. TACKLE CLUB will make every effort to deliver on time.
Customers are responsible to have someone at the delivery address to sign for and accept the delivery. Cost for re-delivery attempts may be passed to the customers if the delivery address is unattended at the time of delivery.
RETURN AND REFUND
Returns for refund will only be accepted within 7 days of you receiving the goods. Returned goods must be in its original condition and be in the original packaging. Shipping and handling cost are not refundable. This return for refund policy is applicable only for manufacturing defects to the product and not for change of mind, and lack of expertise for use of product. All products are visually checked for manufacturing defects before shipment.
Any incorrect, missing or damaged items received must be reported to TACKLE CLUB within 24 hours of you receiving the delivery.
If item(s) received is not what was ordered please do not open the sealed package in which it was sent. Any attempt to use the incorrect item will be deemed to be acceptance by the customer of the item(s) as a satisfactory substitute for the one that was ordered and no further claim can be raised thereafter.
TACKLE CLUB owns the title of any extra goods shipped with your order that have been dispatched in error.
WARRANTY CLAIM
All goods sold by TACKLE CLUB come with a warranty to be free from any defects or faults. This warranty is not transferable.
Goods under warranty cover will be replaced or repaired by the manufacturer. No refund can be provided under any circumstances.
Warranty only covers the item(s) sold by TACKLE CLUB.
Important
A large percentage of returned goods are found to be, not faulty. If the returned goods are determined by TACKLE CLUB to not be faulty, then all returning shipping fees will be worn by the customer and the goods will be sent back by Australia Post COD freight collected. TACKLE CLUB also reserves the right to charge the labour cost for examining these goods where no fault was found.
All warranties are voided if returned product is found in any way to be mishandled, mis-installed, modified, tampered, abused, physically damaged.
Please attach a copy of the original invoice or provide the original invoice number. A detailed fault description sheet must be sent together with all the returning warranty goods.
Customer is responsible for any shipping and insurance cost involved in sending the warranty claim goods back to TACKLE CLUB.
TACKLE CLUB is not responsible for any parcel missing in transit, on its return back to TACKLE CLUB.
DISCLAIMER
Due to changing market forces and other extenuating circumstances that affect product availability, and price stability we reserve the right to withdraw any product we advertise and change prices without notice.
Information contained throughout the web pages and in our database is believed to be accurate and reliable at the time of publishing.
There may be misprints, human errors, and omissions. We reserve the right to make changes and corrections in prices, products, and specifications without notice.
Images displayed on this web site should be regarded as illustrative and informational purpose only. The actual products are often not identical to the images.
Subscriptions & Cancellations
By registering an Account and enrolling in a Subscription (“Enrollment”), you will choose which of our periodic shipments you wish to receive, and also provide other information that will assist us to fulfill your orders and your expectations. We will use such information to fulfill your periodic orders and we may use such information in order to present you with opportunities for additional products that we feel may be of interest to you. You will also register a payment method (e.g., a credit card) and such registration of your payment method constitutes your authorization to charge such amounts to that payment method and otherwise constitutes your promise to pay for items purchased from the Site.
Upon Enrollment, you will choose which one or more of our Subscription plans you wish to order. We will send shipments to you at the frequency and value that you choose. You acknowledge and agree that it is impossible for the value of our shipments to exactly equal the approximate value you have chosen, and your order from Tackle Club signifies your acknowledgment that the value of each shipment will be within $5r of the value that you have chosen. You may change the desired approximate value of your periodic shipment, or cancel your Subscription at any time. Any change or cancellation of Subscription will be effective immediately as to all Products not yet billed to your account as of the date and time of the change or cancellation. Products already billed but not sent as of the date and time of the change or cancellation will be sent as previously scheduled and cannot be refunded. You may change or cancel your Subscription by accessing your Account through the Site or by contacting Customer Service at info@tackleclub.com.au
Your use of the Site is your acknowledgement that you have enrolled to receive fishing-related products that are unknown to you at the time of ordering and receipt by you. Tackle Club offers no refunds or credits for returned Subscription Products. If you did not receive your Subscription shipment during any month, you must contact us within 30 days of that month's shipment date in order to receive a replacement.
Typographical Errors
In the event that a www.tackleclub.com.au product is mistakenly listed at an incorrect price, www.tackleclub.com.au reserves the right to refuse or cancel any orders placed for product listed at the incorrect price. www.tackleclub.com.au reserves the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is cancelled, www.tackleclub.com.au shall issue a credit to your credit card account in the amount of the incorrect price.
Term; Termination
These terms and conditions are applicable to you upon your accessing the site and/or completing the registration or shopping process. These terms and conditions, or any part of them, may be terminated by www.tackleclub.com.au without notice at any time, for any reason. The provisions relating to Copyrights, Trademark, Disclaimer, Limitation of Liability, Indemnification and Miscellaneous, shall survive any termination.

Use of Site
Harassment in any manner or form on the site, including via e-mail, chat, or by use of obscene or abusive language, is strictly forbidden.
